tsvibrav/iStock via Getty Images The U.S. Supreme Court unanimously ruled in favor of the Securities and Exchange Commission's ability to force defendants to surrender alleged illegal profits through "disgorgement," irrespective of the regulator's ability to prove that victims suffered economic harm. The court has already narrowed the SEC's authority several times in the past decade. The current case centers on Ongkaruck Sripetch, whom the SEC accused of penny-stock "pump and dump" schemes involving at least 20 companies that allegedly generated $6.6M in illicit gains. A judge ordered him to pay back $3.3M plus interest. Sripetch had argued the SEC should only be allowed to seek disgorgement when it can show measurable financial harm to victims. The SEC had said the purpose was broader: preventing wrongdoers from keeping unlawful gains. The ruling is believed to impact cases where victims are difficult to identify, including record-keeping violations, insider trading claims, and the agency’s lawsuit against Elon Musk over his delayed disclosure of a growing Twitter stake. Supporters of the SEC's disgorgement authority say the remedy prevents misconduct by stripping wrongdoers of profits. Critics argue the SEC often uses it to raise money for the Treasury rather than compensate harmed investors. In a 9-0 ruling, the Supreme Court upheld a lower court's decision that backed a wide use of the regulator's disgorgement authority. "We conclude that a showing of pecuniary loss is not required before an investor may qualify as a victim of an offender's wrongdoing entitled to compensation," said Justice Gorsuch. "Today the Supreme Court preserved one of the SEC's most potent weapons in its enforcement arsenal," said Jose Lopez, one of the country's top advisors to companies, officers, directors, and trustees in complicated securities litigation. And sellers are not happy. A near record 5.8% of all US home listings were pulled off the market in April, according to Redfin . That’s tied with December 2025 for the highest share since March 2020, when the onset of the pandemic ground the housing market to a halt and spooked sellers. April delistings surged 3.8% month-over-month, the second straight month in which they have increased. Prior to 2020, delistings were never as common as they are now. Delistings are on the rise largely because it’s a buyer’s market. Many homeowners want to sell - but only if they can get the price they want. In many cases, prospective sellers test the waters but pull their home off the market when they don’t get the price or terms that make selling worth it. And with most homeowners in possession of sufficient liquidity buffers to avoid the need for liquidation, expect many more delistings as expectations for rapidly rising home prices crash and burn. “ Sellers are still getting used to the post-pandemic normal ,” said Patricia Ammann, a Redfin Premier agent in Arlington, VA. “ Prices aren’t soaring like they were five years ago–high gas prices and the rising cost of living overall is trickling down to the housing market, making buyers much less likely to bid prices up. Life requires some planning. For example, the paucity of public toilets means mapping alternatives, as bladder bags have much less capacity than a natural bladder.
