US prosecutors dropped a $300 million fraud indictment against a former executive at Prophecy Asset Management accused of working with Brian Kahn, the disgraced founder of Franchise Group Inc. , to cheat investors in their hedge fund. Prosecutors offered no explanation Friday in asking a judge to dismiss the case against Jeffrey Spotts, who had faced a July 6 trial in federal court in Trenton, New Jersey. Both Kahn and another former Prophecy executive, John Hughes, pleaded guilty and were expected to testify against Spotts. But the case foundered this year when prosecutors said evidence involving Kahn included classified information they couldn’t identify publicly. After sealed litigation before US District Judge Michael Shipp , prosecutors told Spotts’ lawyers last month that Kahn wouldn’t testify after all. Shipp dismissed the case late Friday. Spotts, who wasn’t charged until five years after the 2020 collapse of Prophecy, long maintained his innocence. “This is a total, unprecedented, and above all else, a deserved victory for Jeff Spotts,” said his attorney, Lee Vartan . “Jeff was defrauded by Brian Kahn and John Hughes. He did nothing wrong. The government now agrees, and dismissed a $300 million securities fraud indictment fully and completely.” A spokesperson for Robert Frazer, the US attorney in New Jersey, didn’t immediately respond to a request for comment. US authorities say that Prophecy promised investors steady returns and a diversified trading strategy driven by more than 30 “sub-advisers.” No trader was supposed to control too much of the assets, and each was supposed to post collateral. In reality, Kahn managed 78% of Prophecy’s $1 billion in leveraged capital, the US said. In pleading guilty in December, Kahn admitted he conspired to commit securities fraud at Prophecy.
