The Federal Reserve asked a judge to stand firm in his decision to dismiss two Justice Department subpoenas seeking information about building-renovation cost overruns tied to the administration’s legal fight with Chair Jerome Powell . The central bank asked US District Chief Judge James Boasberg to reject a request by US Attorney Jeanine Pirro to reconsider his ruling to quash the grand jury subpoenas. “The president has been waging a pressure campaign against Chair Powell for years in order to try to force interest rates lower, and he has been directing prosecutors to target his enemies throughout his second term,” the Fed said in a filing made public Thursday. The Fed filing argues that the judge should only reconsider if the Justice Department offered new evidence or wanted to correct a “clear error,” defining the latter as “it strikes the court as wrong with the force of a five-week-old, unrefrigerated dead fish.” ‘No Dead Fish’ “The court’s opinion is no dead fish,” the Fed’s filing continues. “It articulates the correct legal standard and properly applies it to the striking facts and circumstances of this case.” The filing is the latest maneuver in a legal battle that pits the independence of the Federal Reserve against the Justice Department’s power to carry out investigations. The fight also threatens to delay the confirmation process for President Donald Trump’s hand-picked Fed chair nominee, Kevin Warsh , to take over at the central bank. The next development is expected to be a ruling by Boasberg on the motion to reconsider. That would set the stage for an appeal by the side that loses.
