A US trade court judge on Wednesday ordered the government to begin paying potentially billions of dollars in refunds to importers who paid tariffs that the supreme court said last month were collected illegally. Richard Eaton, a judge of the US Court of International Trade in Manhattan, ordered the government to finalize the cost of bringing millions of shipments into the US without assessing a tariff, according to a court filing. He ordered the refunds to be made with interest. When merchandise is brought into the United States, an importer pays an estimated amount at entry which is then finalized around 314 days later, a process known as liquidation. Eaton directed Customs and Border Protection to finalize the entry cost on shipments without the tariff being assessed, resulting in a refund. “Customs knows how to do this,” he told a court hearing on Wednesday, according to a recording on the court’s website. He said the agency should be able to program its system to issue refunds, which are regularly issued when an importer overpays on an estimated duty. “They do it every day. They liquidate entries and make refunds,” he said. Eaton also set a hearing for Friday in which he asked for updates on CBP’s refund plans. He said in his order that the court’s chief judge indicated that Eaton is the only judge who will hear tariff refund cases. Customs and Border Protection has said in court filings that the task of finalizing entry costs without assessing a tariff was “unprecedented” in scale and could require manual review of more than 70m entries. Included in the transaction are Valley Fair in Minnesota, Worlds of Fun in Kansas City, Michigan’s Adventure, the Schlitterbahn Waterpark in Galveston, Texas, Six Flags St. Louis, Six Flags Great Escape in Queensbury NY, and Six Flags La Ronde in Montreal. These parks all generate ~$260M in net revenue and ~$45M in adjusted EBITDA. The proceeds of the sale will be used to pay down debt. Last quarter, the company had $5.18B in long-term debt with cash and cash equivalents of $91M. “By focusing our resources on the parks that we believe have the highest growth potential, we expect to drive operating leverage, expand margins, and accelerate our cash flow generation,” said Six Flags Entertainment CEO John Reilly. The decision to unload seven parks comes in the wake of disappointing fourth-quarter results in which the company fell further into the red with a loss of $0.91 per share. This largely reflected a 9% drop in Q4 admission revenue and a 13.3% drop in attendance. And while expenses were down, this was a result of fewer visitors to the parks and reductions in seasonal labor, some of which were offset by higher property taxes and higher wage costs. Over the past year, shares of Six Flags Entertainment ( FUN ) have consistently underperformed the S&P 500, lagging the benchmark index by 76 percentage points. The reason why I back then assigned a Buy rating was related mainly to conservative leverage and attractive floating vs. fixed-rate loan book positioning amid a declining interest rate environment. However, a couple of months later, seeing that FSCO had significantly outperformed the Business Development Company ("BDC") index ( BIZD ) - by about 14% on a total return basis - and also recognizing that the Fund had an exposure to bankrupt First Brands business, I thought to myself that it was a timely moment to exit. The increasingly stretched dividend coverage was also what motivated me to assume a bearish stance, as outlined in the article FSCO: Big Downside Risk And Almost Certain Yield Cut (Downgrade). Finally, the presence of some similar yield but higher quality BDC alternatives made the choice even easier. Since that moment, it has been "nothing but net" for my thesis: YCharts Now, such kinds of drawdowns open the door for some logical questions around too aggressive discounting and thus potentially compelling entry points. These could be my initial thoughts from the bull's perspective: FSCO yields 15.5%, which is the highest yield it ever has provided. The Fund trades at ~27% discount to NAV. The ~20% delta in total return performance relative to BDCs is interesting, potentially unjustified given the various overlaps between them. However, in all fairness, I do not think that it is the right time to enter FSCO. Let me flesh out the reasoning below. The World Bank has earmarked $500 million to rehabilitate the commuter rail network in Kenya’s capital. The project, which is at the concept review stage, will include upgrades to stations, the purchase of rail carriages and other infrastructure investments in Nairobi, according to a note on the lender’s website. The total cost is estimated at $1.7 billion. “The project aims to transform the Nairobi metropolitan area mobility landscape by upgrading the commuter rail into a modern urban rail system, reforming the institutional framework for urban transport, and supporting integrated land-use planning around stations,” the Washington-based lender said. The bank will support feasibility studies and preliminary design work for Kenya’s commuter railway system “including electrification readiness,” and will provide technical assistance for carbon financing opportunities, it said. Policy support under the program includes the “establishment of urban mobility funding mechanisms including potential securitization of the Railway Development Levy,” according to the World Bank note. The project will later be expanded via support studies and design activities related to urban mobility in Kenya’s key secondary cities including Mombasa, Kisumu, Nakuru and Eldoret, it said.

In February, Anthropic's AI models and agent plugins spooked the market, causing a major pullback among SaaS companies. Some called it the SaaSpocalypse trade. In my view, ADBE's recent selloff has largely been driven by sector beta. In my last 2Q FY2025 analysis , I reiterated a Buy rating on ADBE, arguing that fundamentals remained healthy, though AI monetization was in its early stages. The company's growth even accelerated in 2H FY2025. However, valuation multiples have compressed by almost 50% since my last rating, trading at 11.5x non-GAAP P/E fwd. Six months later, ADBE reported solid 4Q FY2025 earnings, beating all estimates. Key growth metrics, such as ARR and RPO remain resilient. I believe this valuation derating reflects a concern that the company could be in a "value trap" or a potential AI loser. Bears argue that ADBE may face structural growth headwinds due to intensified competition in the digital creation market. For the 1Q FY2026 earnings next week, we should monitor two things: full-year guidance and management's commentary on how to face agentic AI disruptions and integrate them into their products. We've seen dip buyers step in over the past 5 trading days, pushing the stock 7% higher from the bottom. I believe this was a panic selloff, and panic selloffs often create buying opportunities. ADBE is no doubt a high-quality stock, trading at a "dirt cheap" valuation in terms of earnings and FCF, with net cash on the balance sheet.
